In this video, I explain California Penal Code 837, which is commonly known as citizens’ arrest. The Netflix documentary “The Nigth Stalker” is used as a perfect example and illustration of citizen’s arrest. Ramirez aka The Night Stalker, the wanted serial killer, was chased across LA. He ran across the freeway and tried to steal two separate vehicles. As he ran, the citizens in the neighborhood began to realize who the man was from the newspapers and local news. In the end, the police didn’t catch the Night Stalker, the public did when they grounded him in a citizen’s arrest.
The Night Stalker was found guilty on 43 counts, and charged with 13 murders, five attempted murders, 11 sexual assaults, and 14 burglaries. He was sentenced to 19 life sentences and ruled to die by gas chamber.
Under California Penal Code 837, a private person may arrest another:
- For a public offense committed or attempted in his presence.
- When the person arrested has committed a felony, although not in his presence.
- When a felony has been in fact committed, and he has reasonable cause for believing the person arrested to have committed it.
